1. Agreement
These Terms of Service (“Terms”) govern your use of the Alarm Buddy iOS application and related website (together, the “Service”), provided by Hemant Kumar (“Alarm Buddy,” “we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use Alarm Buddy. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.
2. What Alarm Buddy provides
Version 1.4 of Alarm Buddy lets you:
- set, edit, turn off, or delete one recurring wake alarm on a compatible iPhone;
- choose one first morning action;
- choose the ordinary Stop action or the optional Start with Biscuit action when the alarm rings;
- use or skip a short, gentle transition guided by Biscuit.
Alarm Buddy requires iOS 26 or later and uses Apple’s AlarmKit framework. It is not a multi-alarm manager, habit tracker, game, medical product, or emergency alerting service.
3. Safety and alarm responsibility
Alarm behavior can be affected by authorization, device state, power, software, hardware, system changes, configuration, and circumstances outside our control. You are responsible for checking the time, selected days, on/off state, Alarm permission, device condition, and any other settings relevant to your use.
Until Alarm Buddy has rung correctly for you on three mornings, keep your usual backup alarm set five minutes later. Use an independent backup for important appointments, travel, work, medication, caregiving, or any situation where a missed or delayed alarm could cause harm.
Stop or skip movement if you feel dizzy, unwell, or unsafe. Turn on a light if useful and avoid stairs while you are still waking up.
Alarm Buddy is not a medical device, treatment, emergency alert, life-safety system, or mission-critical timing service. Do not use it as a substitute for professional medical advice, an appropriate medical device, emergency services, or a dedicated safety system.
4. Limited licence and acceptable use
Subject to these Terms and the App Store rules, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Alarm Buddy for lawful, non-commercial purposes on Apple devices you own or control.
You may not:
- copy, sell, sublicense, distribute, or commercially exploit the Service except as law expressly permits;
- reverse engineer, bypass, interfere with, or misuse the Service except where applicable law does not allow that restriction;
- use the Service unlawfully or to infringe another person’s rights;
- introduce malicious code, probe security, or disrupt the Service or its providers;
- remove ownership, copyright, or attribution notices.
5. Your content and feedback
You retain your rights in text or messages you choose to provide. You give us permission to use support reports and feedback to operate, troubleshoot, and improve Alarm Buddy. We will handle personal information as described in the Privacy Policy.
If you send an idea or suggestion, you understand that we may already be considering similar ideas and may use non-confidential feedback without payment or obligation to you.
6. Privacy and third-party services
Our Privacy Policy explains the app’s on-device data, Mixpanel analytics linked to a random app identifier, and support/interview email handling.
The Service also depends on third-party services and terms, including Apple’s iOS, AlarmKit, and App Store services; Mixpanel analytics; and Google’s email services when you contact the Gmail support address. We do not control those providers and are not responsible for their independent services.
7. Updates, availability, and termination
We may update, change, suspend, or discontinue all or part of the Service. An iOS or app update may be required for continued use. We do not promise that every feature will remain available or work on every device, region, or future iOS version.
You may stop using Alarm Buddy at any time and may delete it from your device. We may suspend or terminate access if you materially breach these Terms or if necessary to protect users, the Service, or legal rights. Provisions that should reasonably survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will continue to apply.
8. Ownership
Alarm Buddy, Biscuit, the software, designs, artwork, text, and related intellectual property are owned by Hemant Kumar or the relevant licensors and are protected by applicable intellectual-property laws. These Terms grant only the limited right to use the Service described above.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or reliability.
To the maximum extent permitted by law, Alarm Buddy and Hemant Kumar will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, missed appointments, missed travel, employment or business loss, or harm arising from a missed, late, incorrect, or unobserved alarm.
To the maximum extent permitted by law, our total liability arising from the Service will not exceed the greater of the amount you paid for Alarm Buddy during the 12 months before the claim or US$10. Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.
10. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Alarm Buddy and Hemant Kumar from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Service, your material breach of these Terms, or your infringement of another person’s rights.
11. Apple App Store terms
You acknowledge that these Terms are between you and us, not Apple. Apple is not responsible for the Service or its support. Your use must comply with the App Store Usage Rules. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
Where required by Apple’s standard terms, Apple may have responsibilities relating to refunds, product warranties, intellectual-property claims, or product claims only to the extent stated in Apple’s rules or required by law.
12. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before filing a claim, you agree to contact us and try to resolve the dispute informally in good faith. Subject to mandatory consumer law, courts in India will have jurisdiction over disputes arising from these Terms or the Service.
13. General terms
If a provision is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganisation, transfer, or sale of the Service. These Terms and the Privacy Policy are the entire agreement about the Service unless additional terms expressly apply.
We may update these Terms. Changes take effect when posted with a new effective date, unless applicable law requires a different notice or consent process. Continued use after the effective date means you accept the revised Terms.
